Coexistent Agreements

For avoiding an objection to a newer trademark-application because of older rights of a third party, it could be advisable to reach an impenetration agreement, which usually defines - e.g. by means of a disclaimer - the limitation of goods and services covered by the more recent trademark. Such impenetration agreements should not be confounded with contracts defining the grant of trademark-licenses.
